Animation License Agreement

This License Agreement governs only Beat Catz Animations that you Download.

1. Definitions

Animations - means any work available at this link.
Download and variations - means downloading, obtaining or copying Animations from the Website, email or other ways through Beat Catz store.
License means the license granted to you under this Agreement.

2. Ownership. 

Beat Catz does not grant title or ownership in Animations. All rights in Animations not expressly granted in this agreement are reserved by Beat Catz for itself and its licensors. Beat Catz can license the same Animation to other customers.

3. Licence
If you have purchased an Animation: We hereby grant you a non-exclusive, worldwide right and license on the terms and subject to the conditions and limitations set out in this Agreement, to: use, copy, edit, modify, manipulate, publicly perform, advertise, couple, synchronize the downloaded Animation  within Creations in the uses authorized in this agreement.

4. License Tiers

INDIVIDUAL LICENSE 

Personal and Commercial Use:

  • You may allow access to or use of raw downloaded Animation on your behalf to no more than 1 individual for Project.

Project - means Production which incorporates or combines the Content together with other substantial independently created works, and is created by or for you or on your behalf or for one of your clients (total number of clients is 1).

Permitted Use:

  • Video Clip
  • Presentation
  • Website Design
  • ECards
  • Email and Presentation Template
  • Online Publication
  • Digital Advertisement
  • Education 

You may request authorization for a Permitted Use not covered by this agreement (“New Permitted Use”) by writing beatcatzshop@gmail.com 

Permitted Distribution Channels:

  • YouTube
  • Spotify
  • Facebook 
  • Tik Tok 
  • Instagram 
  • Snapchat 
  • Twitter
  • Pinterest
  • Bandcamp 
  • Apple Music 
  • SoundCloud 
  • Your website or mobile app 
  • Websites where You sell Your Single Project and You need to add attachment with digital Animation from Beat Catz. 
  • Email   
You may request authorization for a use Distribution Channels not covered by this agreement (“New Distribution Channel”) by writing beatcatzshop@gmail.com 

WHAT YOU CAN NOT DO WITH OUR INDIVIDUAL LICENSE ?

  • You can not Resale or Distribution downloaded Animation.
  • No Use in Trademarks or Logos: You may not incorporate any Animations  into a logo, trademark or service mark.
  • No  Use in physical Merchandise.
  • No unlawful use: You may not use the Animation in a pornographic, political, illegal or defamatory context.
  • You may not falsely represent that you are the original creator of a work that is made up largely of licensed content.
  • Sub-Licence Our Animations cannot be sub-licensed, resold, shared, redistributed or transferred to the third party.

BUSINESS LICENSE

Personal and Commercial Use:

  • Business License -  you may allow access to or use of raw Animation on your behalf to no more than a total of 10 persons over time for Different Projects.

Different Projects - means Productions which incorporates or combines the Content together with other substantial independently created works, and is created by or for you or on your behalf or for your clients (total number of clients is 10).

  • Video Clips
  • Presentations
  • Website Design
  • ECards
  • Email and Presentation Templates
  • Online Publications
  • Digital Advertisements
  • Education

5. No Attribution Required

You are not required to credit Beat Catz in your works. But it will be nice if you mention us to your friends and followers :).

6.  Liability
The Beat Catz parties and the Animation contributors shall not be liable to You or any other person or entity for any punitive, lost profits or any other demages, costs or losses arising under this agreement or out of or related to the license, Your or any of Your representatives. Any dispute relating to or arising from this Agreement, the License, the Animation or the use thereof will be resolved exclusively by a court in Poland.

7. Changes to Animation License Agreement.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our Animation License Agreement.
